AG calls for stronger open meetings law as part of 2016 legislative agenda

Washington State Attorney General Bob Ferguson today announced his proposed bipartisan legislation to increase transparency in government by enhancing penalties for violations of Washington's Open Public Meetings Act (OPMA).

The OPMA requires that all meetings of multimember governing bodies of local and state public agencies be open and accessible to the public. Passed in 1971, the law was designed to ensure the public has ready information and access to the agencies established to serve them.

Ferguson's proposal would modernize the out of date penalty provisions of the OPMA. The current penalty for violating the OPMA is $100, unchanged since the act was enacted in 1971.cheap nfl jerseys

Ferguson's request legislation would increase the penalty to $500 for a first time violation, roughly in line with inflation. It would also enact a new $1,000 "repeat violator" penalty for a subsequent knowing violation of the act.

"Open government is vital to an informed democracy," said Ferguson. "When the law requires an open meeting, yet officials knowingly close the door on the public, they must be held accountable with meaningful penalties."

The Attorney General request legislation, House Bill 2353, is sponsored by Rep. Sam Hunt, D, Olympia. The companion bill, Senate Bill 6171, is sponsored by Sen. Pam Roach, R Sumner.

"It is essential that our elected officials understand and follow the Open Meetings Act," said Hunt, chair of the House State Government Committee. "One should not be slapped on the wrist for knowingly violating the open meetings provisions. This law has been with us since 1971, and this bill, for the first time since approved by the Legislature, updates to 2016 levels the penalty for knowingly violating the Open Public Meetings Act."

"To hold government accountable, we need to know what's going on," said Roach, chair of the Senate Government Operations and Security Committee. "No more secret meetings. Those officials who knowingly and repeatedly violate our open meeting laws should face a penalty painful enough to discourage them from ever doing so again."

The OPMA requires open meetings of multimember, public agency governing bodies such as city councils, county commissions, school boards, and many state boards. The OPMA does not presently include enhanced penalties for repeat violations.

Members of the governing body are personally liable for violations and pay any penalties out of their own pockets. While the public agency does not pay the penalty, agencies do pay associated attorneys' fees and costs.

Other states, including Arizona, Florida, Idaho, Iowa, Kansas, Minnesota, Mississippi, Nevada, Rhode Island and Virginia, currently have higher penalties for open meetings violations than Washington. At least one state New Jersey has enhanced penalties for repeat violators.

If they look back, Lloyd Carr lost four games in each of his first two seasons, and that was without having to go through a complete overhaul of the offensive system. The Sugar Bowl gave a false sense of accomplishment, but Michigan has an excellent defensive coordinator, and five players on USA Today's All USA High School Football Team. It is ugly growing pains with the offensive line this year, but with all the youth there, as well as who is coming in, I think if Michigan fans can sit on their hands for another year or two, they will be extremely happy they did.

Adam Rittenberg: Some really good points here, Greyson, especially about the Sugar Bowl inflating the expectations for Hoke. The hard thing to reconcile is the exceptional recruiting and the mediocre results, although many of those players need more time to develop. The other difficult thing for Michigan fans is seeing a team that doesn't reflect the values Hoke preaches about, especially toughness along the line of scrimmage. Michigan should always be able to run the ball, but Hoke's teams have had a hard time doing so the past two seasons, and especially in recent weeks. It will be interesting to see how the season ends, but I don't think a coaching change makes much sense now. Why? Because I think it would be better for the B1G to have Ohio State beat Stanford in the Rose Bowl while Wisconsin and Michigan State beat good SEC teams in Florida than to have the Buckeyes serve as the next sacrificial lamb for the Tide. I know some think FSU can give 'Bama a game but they are no better analysts than those who thought ND would last year. I live in ACC country and the ACC is atrocious this year. What do you think?

Adam Rittenberg: Lance, if your assumption is Alabama would smash Ohio State, then the scenario you outline is certainly better for the Big Ten. A Rose Bowl win, one of few for the Big Ten in recent years, would help perception, and so would a strong overall bowl record. I think Michigan State and Wisconsin could hold their own against good, but not great, SEC teams in the Capital One and Outback Bowls. And this scenario would prevent Big Ten teams from moving up a spot, creating potential mismatches.

That's not happening this year, but Minnesota still should go somewhere nice for its bowl.

She was tired of washing the same jersey over and over again when the Bombers had games on back to back days. She wanted the team to have another option.So Scherle told her new coach, Jenny Lichty, who appreciated the honesty. The first year head coach never had to guess what her senior captain was thinking, which was a luxury to have both during practice and in discussions regarding a new uniform option."She always and it's in a good sense but she always spoke her mind," Lichty said. "She always told you what she was thinking. That's a nice thing going in, so you're not sitting there wondering what's going through her head."Scherle ultimately got her wish. Ballard received new navy shirts to wear in lieu of their usual white jerseys for the 2015 season. That aggressiveness she showed in getting her team alternate uniforms also extended to the field of play, where the Wisconsin bound centerfielder excelled.Scherle hit .587 this year. She knocked in 21 RBIs and stole 43 bases on 45 attempts, helping the Bombers to a 21 13 record. For her efforts, Scherle earned first team all state honors and was voted the 2015 All Area softball player of the year."She has a very positive mentality," Lichty said. "You look at her batting average, batting over .500 she always went up to the plate knowing she was going to get on base."That mindset developed largely because of the work Scherle put in during the off season. For the last four years, she has steadily flourished under the teachings of Greg Dickel, one of the best slapping instructors in the country.Scherle first came to Dickel as a right handed hitter, but Dickel gradually taught her to hit from the other side of the plate. Scherle struggled at first, Dickel said, which only made her work harder to master the slapping technique and her famous one handed run bunt.cheap nfl jerseys "It wasn't all sunshine and rainbows," Dickel said. "The first year or two she was with me, when she was learning how to slap, she wasn't very good at it, so she didn't play a whole lot. She doesn't take well sitting on the bench."But she stuck through it."The results are impressive. More recently, she led her club team, the Iowa Premier Gold softball team (which Dickel coaches), to the 18 and under PGF national championship game."I've had several Division I kids in the last four years, probably 20 plus, and she's probably right there with some of the best that I've coached," Dickel said. "She's probably the best pure athlete I've ever coached."The natural athletic ability she has, and all the work she's put into the skills I mean, that's why she's going to go play Division I softball. Those in state schools that passed her over are going to regret it."Lichty noticed Scherle's work ethic during the season, too. On multiple occasions, Scherle would stay after practice to work on certain slapping techniques. During workouts, if Scherle didn't like the way she executed a specific drill, she would ask the coach to go again."A lot of other players followed suit with that too," Lichty said. "It's that philosophy of, don't do it until you get it right, do it until you can't mess up."It's that lasting impression Scherle hopes she made on the team she will leave behind.
